When: If you
want to use your property in a way that may not be permitted under its
current zoning district.
Why: The City of
Markesan Zoning Ordinance divides all land into zoning districts that
cover various classes of land uses such as, residential, commercial, or
industrial. Each district has specific regulations concerning setbacks
and allowable land uses. This is done to protect property owners and
citizens from uses that could affect their enjoyment of their property
and to ensure basic standards for health and safety.
Whenever the public
necessity, convenience, general welfare, or good zoning practice
require, the City may, by ordinance, change the district boundaries.
All changes are subject to the review and recommendation of the Planning
Commission, and may be initiated by the Council, the Planning
Commission, or the owner or lessee of the property within the area
proposed to be changed.
Rezoning Process:
Step 1 –
Application forms for re-zoning may be obtained from the Clerk-Treasurer
and should contain a description of the premises to be rezoned, list the
reasons justifying the petition, and specify the proposed use. The
following information should also be attached to the petition:

A plot plan showing the area proposed to be rezoned, its
location, its dimensions, the location and classification of adjoining
zoning districts and the location and existing use of all properties
within 200 feet of the area proposed to be rezoned.

Step 2 – The
Building Inspector will review the zoning request and may request
further information for the upcoming public hearing. Notices of the
public hearing will be sent out to all property owners within 200 ft. of
the proposed area to be rezoned. The public will have a chance to
respond to the zoning request at the public hearing. The notice will be
published twice in the official City newspaper.
Step 3 - The
Planning Commission will hold a public hearing to hear public input on
the applicant’s request. It is encouraged that the applicant or his
representative be present at the Planning Commission Public Hearing to
answer any questions. After careful review and consideration of the
proposed changes, the Planning Commission will recommend that the
petition be granted as requested, modified or denied.
Step 4 - The
Common Council shall vote on the passage of the proposed change based on
the Planning Commission’s recommendation. If the Council denies the
proposed change, a similar petition for such change may not be submitted
for a period of one year. |
